These Terms of Service ("Terms") form a legally binding agreement between you ("you" or "your") and the provider of Mass Unsubscribe Gmail ("Mass Unsubscribe", "we", "us" or "our") and govern your access to and use of the Mass Unsubscribe Gmail Chrome extension, the mass-unsubscribe.com website, and any related features, paid subscriptions and services (together, the "Services").
By installing, accessing or using the Services, or by purchasing a subscription, you confirm that you have read, understood and agree to be bound by these Terms and by our Privacy Policy, which is incorporated by reference. If you do not agree to these Terms, please do not install or use the Services.
If you are using the Services on behalf of a company or other organisation, you represent that you have authority to bind that entity to these Terms, in which case "you" refers to that entity.
Who We Are
The Services are provided by Yuliya Kryshyna, a sole proprietorship (jednoosobowa działalność gospodarcza) registered in the Central Registration and Information on Business (CEIDG) in Poland, NIP 5273173624, with a registered address at ul. Jaktorowska 8/33, 01-202 Warszawa, Poland (referred to as "we", "us" or the "Provider"). You can reach us using the contact details at the end of these Terms.
The Service
Mass Unsubscribe Gmail is a Chrome browser extension that connects to your Gmail account, scans your inbox to find the senders and mailing lists that email you, and lets you unsubscribe from them, delete their emails in bulk, or move them to spam. To do this, the extension uses the Gmail API with the permissions you grant during sign-in, as described in our Privacy Policy.
Mass Unsubscribe Gmail is an independent product and is not affiliated with, endorsed by or sponsored by Google LLC. Gmail and Chrome are trademarks of Google LLC.
Some features are available free of charge, while others require a paid subscription. We may add, change or remove features over time. We do not guarantee that any particular feature will always be available.
Eligibility
You must be at least 18 years old, or the age of majority in your jurisdiction, and have the legal capacity to enter into a binding contract, in order to use the Services or make a purchase. By using the Services you represent and warrant that you meet these requirements.
Sign-In and Accounts
The Services require you to sign in with your Google account using Google OAuth. You are responsible for maintaining the security of the Google account you use to sign in and for all activity that occurs under it. You agree to provide accurate information and to notify us promptly of any unauthorised use. We are not responsible for any loss arising from your failure to keep your account credentials secure.
You can revoke the extension's access to your Google account at any time from your Google Account permissions page. Revoking access does not cancel a paid subscription; see Cancellation below.
Licence to Use the Service
Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, non-sublicensable and revocable licence to install and use Mass Unsubscribe Gmail for your personal or internal business use.
Paid features are provided on a subscription basis. Your right to use paid features lasts only while your subscription is active and paid.
Licence Restrictions
Except as expressly permitted by these Terms or by applicable law, you must not:
- Sell, resell, rent, lease, sublicense, distribute or otherwise commercially exploit the Services or your subscription;
- Share your subscription or access with any other person, or use a subscription you did not lawfully obtain;
- Copy, modify, translate, or create derivative works of the Services, except to the extent this restriction is prohibited by applicable law;
- Reverse engineer, decompile or disassemble the Services, or attempt to derive their source code, except to the limited extent permitted by mandatory applicable law;
- Circumvent, disable or interfere with any usage limit, billing, security or technical protection mechanism, or remove any proprietary notices;
- Use the Services for any unlawful purpose, or in any way that infringes the rights of others or violates these Terms.
Free and Pro Plans
The Free plan lets you use the Services at no cost, subject to the usage limits shown on our Pricing page. The Pro plan removes those limits and is available as a monthly or yearly subscription. The features included in each plan, the price and the applicable currency are shown on our Pricing page and at the point of purchase.
We do not sell one-time or lifetime licences. All paid access to the Services is provided through a recurring subscription.
Subscriptions, Billing and Renewal
When you purchase a Pro subscription, you authorise us to charge the subscription price for the billing period you selected (monthly or yearly). Your subscription renews automatically at the end of each billing period, and you will be charged the then-current price for the same period, until you cancel.
Payments are processed by a third-party payment provider, which may act as our authorised reseller and Merchant of Record. Where it does, the payment provider handles the transaction, billing and applicable sales taxes or VAT, and your payment is also subject to its own terms and privacy policy. We do not collect or store your full payment card details.
We may change our subscription prices from time to time. Price changes never apply to a billing period you have already paid for. If the price of your subscription changes, we will notify you in advance, and the new price will apply from your next renewal. If you do not agree to the new price, you can cancel before the renewal date.
If a payment fails, we or our payment provider may retry the charge. If the payment still cannot be collected, your subscription may be suspended or cancelled and your account will return to the Free plan. You are responsible for any taxes that are not collected by the payment provider where required by law.
Cancellation
You can cancel your subscription at any time, using the subscription management link provided with your purchase receipt or by emailing us at extensionmassunsubscribe@gmail.com. Cancellation stops future renewals. You keep access to Pro features until the end of the billing period you have already paid for, after which your account returns to the Free plan.
Uninstalling the extension or disconnecting your Google account does not cancel your subscription.
Refunds
Subscription payments are non-refundable. We do not provide refunds or credits for partially used billing periods, for periods in which you did not use the Services, or for renewals you did not cancel in time. We encourage you to try the Free plan before subscribing so you can confirm that the Services work for you.
We will correct duplicate charges or billing errors caused by us or our payment provider. Full details are set out in our Refund Policy.
Nothing in these Terms limits or excludes any statutory refund or consumer rights you may have under the mandatory laws of Poland, the European Union, or your country of residence.
Right of Withdrawal (EU/EEA Consumers)
If you are a consumer in the European Union or European Economic Area, you generally have the right to withdraw from a distance contract within 14 days without giving a reason, in accordance with the EU Consumer Rights Directive and the Polish Consumer Rights Act (ustawa o prawach konsumenta).
Pro features are made available immediately after purchase. By completing your purchase, you expressly request that we start providing the Services immediately, and you acknowledge that:
- to the extent the Services are digital content, you lose your right of withdrawal once supply has begun; and
- to the extent the Services are a digital service, if you withdraw within the 14-day period, you must pay an amount proportionate to what was provided until you informed us of your withdrawal, and you lose your right of withdrawal once the service has been fully performed,
in each case to the extent permitted by applicable law.
Actions in Your Mailbox
The Services act on your Gmail account only when you instruct them to. You are responsible for reviewing the senders you select before unsubscribing, deleting emails or moving emails to spam.
- Unsubscribing sends an unsubscribe request to the sender using the method the sender provides. We cannot guarantee that a sender will honour the request or how quickly it will do so.
- Deleting moves the selected emails to your Gmail Trash. Gmail permanently deletes emails in Trash after 30 days, after which they cannot be recovered by you or by us.
- Moving to spam moves the selected existing emails to your Gmail Spam folder. It may not prevent future emails from that sender from reaching your inbox.
We are not responsible for emails you choose to delete, for unsubscribe requests that senders ignore, or for the behaviour of Gmail or any sender.
Acceptable Use
When using the Services, you agree that you will:
- Comply with all applicable laws and regulations, including those relating to privacy and data protection;
- Only connect Gmail accounts that you own or are authorised to manage;
- Comply with Google's terms of service and policies that apply to your Google account;
- Not use the Services to send unsolicited messages, to overload or abuse third-party systems, or to interfere with the normal operation of Gmail;
- Not use the Services to introduce malware, or to disrupt, damage or gain unauthorised access to any system or network.
You are solely responsible for your use of the Services. We are not responsible for how you use the Services or for any consequences arising from actions you take with them.
Intellectual Property
The Services, including the Mass Unsubscribe Gmail extension, the website, software, design, text, graphics, logos and the "Mass Unsubscribe" name, are owned by the Provider or its licensors and are protected by intellectual property laws. All rights not expressly granted to you are reserved.
These Terms do not grant you any right to use our trademarks, logos or brand features without our prior written permission, except as part of normal use of the Services.
Third-Party Services
The Services rely on or interact with third-party services, including Google (for sign-in and access to Gmail), our payment provider (for payments), and analytics and error-monitoring services, as well as the senders you choose to unsubscribe from. We are not responsible for third-party services, and your use of them may be subject to their own terms and privacy policies. We do not endorse and are not liable for any third-party content or websites, including unsubscribe pages operated by senders.
Disclaimers
The Services are provided on an "as is" and "as available" basis. To the fullest extent permitted by applicable law, we disclaim all warranties of any kind, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
We do not warrant that the Services will be uninterrupted, timely, secure, error-free, or compatible with any particular device, browser version or email sender, that every subscription in your inbox will be detected, or that every unsubscribe request will succeed. Availability of the Services also depends on Google's APIs and policies, which are outside our control.
Limitation of Liability
To the fullest extent permitted by applicable law, we will not be liable for any indirect, incidental, special, consequential or punitive damages, or for any loss of profits, revenue, data or emails, arising out of or in connection with your use of, or inability to use, the Services.
To the fullest extent permitted by applicable law, our total aggregate liability for any claim relating to the Services or these Terms will not exceed the total amount you actually paid us for the Services in the 12 months before the event giving rise to the claim, or, where you have not paid us anything, EUR 20.
Nothing in these Terms excludes or limits our liability where it would be unlawful to do so, including liability for death or personal injury caused by negligence, for fraud or fraudulent misrepresentation, or for any statutory rights of consumers that cannot be excluded or limited by law.
Indemnification
To the extent permitted by applicable law, and except where you are acting as a consumer, you agree to indemnify and hold harmless the Provider from any claims, damages, liabilities and expenses arising out of your misuse of the Services or your breach of these Terms or of any applicable law.
Suspension and Termination
We may suspend or terminate your access to the Services, including any subscription, if you materially breach these Terms or use the Services unlawfully. Where reasonable and permitted by law, we will give you notice and an opportunity to remedy the breach.
If we discontinue the Services entirely for reasons other than your breach, we will stop future renewals and refund the unused portion of any prepaid subscription period.
You may stop using the Services at any time by cancelling your subscription and uninstalling the extension. Provisions that by their nature should survive termination, including those on intellectual property, disclaimers, limitation of liability and governing law, will continue to apply.
Changes to the Service and These Terms
We may update these Terms from time to time. We will post any changes on this page and revise the "Last Updated" date above. If we make material changes, we will provide reasonable notice as required by law. Your continued use of the Services after changes take effect constitutes your acceptance of the updated Terms.
Governing Law and Disputes
These Terms and any dispute arising out of or in connection with them are governed by the laws of Poland, without regard to conflict-of-law rules. If you are a consumer, you also benefit from any mandatory provisions of the law of the country in which you reside, and nothing in these Terms deprives you of that protection.
Any disputes will be subject to the jurisdiction of the competent courts of Poland. If you are a consumer, you may also bring proceedings in the courts of your country of residence, or contact your local consumer protection body for help resolving a dispute out of court.
General
If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will remain in full force and effect. Our failure to enforce any right or provision is not a waiver of that right. You may not assign or transfer these Terms without our consent; we may assign them in connection with a merger, acquisition or sale of assets. These Terms, together with the Privacy Policy and Refund Policy, constitute the entire agreement between you and us regarding the Services.
